ABA sues FTC over applying 'red flags rule' to lawyers
Proskauer Rose has filed suit yesterday for the American Bar Association (ABA) in the U.S. District Court for the District of Columbia against the Federal Trade Commission (FTC), seeking an injunction to block the application of the so-called Red Flags Rule to practicing lawyers. The new regulations requires businesses and organizations that act as “creditors” to establish a program for preventing identity theft. The ABA argues that an application to lawyers would be "arbitrary, capricious and contrary to law".
