Australian firm Blake Dawson warns of unregulated litigation funding
Australian law firm Blake Dawson has warned that a lack of regulation concerning legal financiers could lead to a US-style litigation culture. Blake Dawson partner John Emmerig says that shareholder class actions and product liability class actions are on the rise, and that there is also increased activity in environmental class actions. Emmerig says that following a 2006 High Court ruling, litigation funders have been permitted to fund class actions, and that there are significant financial incentives for the support of claims.
