Orrick, Dechert reach settlement in Whole Foods antitrust case
Whole Foods' battle against the Federal Trade Commission (FTC) is finally over. In 2007 the FTC lawyers tried to prevent the merger of Whole Foods and Wild Oats by filing suit in the U.S. District Court for the District of Columbia. Whole Foods and the FTC have now reached a settlement settlement according to which Whole Foods will sell 12 Wild Oats stores and one of its own in order to satisfy the FTC. Whole Foods was advised by Dechert partner Paul Denis and Orrick, Herrington & Sutcliffe's heavyweight Lanny Davis.
