Job offer deferral leads to court action

August 20, 2010 Sarah Martinez is suing San Francisco-based Howard, Rice, Nemerovski, Canady, Falk & Rabkin after the firm offered her a job only to defer her start date and then rescind the offer altogether.

According to Martinez’s lawyer, Kathleen Lucas, law students with a job offer from a large firm usually stop interviewing. So by the time they are told that there is no job for them at the firm, they’ve lost a full year of job-searching.

Martinez’s cause of action also includes allegations discrimination on the basis of her gender and Mexican ancestry alongside the claim that there has been a breach of contract.
